Terms of Service
These terms govern your use of saviena.app and the SAVIENA service. By using the site or signing up, you agree to them. If you do not agree, do not use the service.
What SAVIENA provides
SAVIENA installs AI infrastructure (receptionist, workflow automation, customer journey orchestration) for service businesses. The service is sold in three tiers (Starter, Growth, Scale) on a monthly subscription basis with optional setup fees.
How billing works
- Monthly subscriptions are billed in advance.
- Setup fees are charged once at the start.
- Annual subscriptions are billed in advance for 12 months at a 20% discount.
- Payment is via Stripe. We do not store credit card numbers on our servers.
Our guarantee
If we do not deliver at least 10 qualified leads to your business in the first 30 days, you do not pay for that month. To qualify for this guarantee:
- You must complete the discovery and onboarding process
- Your phone number and lead capture forms must be live with our system
- You must respond to qualified leads we deliver (we cannot guarantee outcomes if you ignore them)
We define "qualified lead" as a contact who: matches your stated ideal customer profile, has expressed clear intent to buy, and has provided contact information for follow-up.
Cancellation
Monthly subscriptions are month-to-month after an initial 90-day commitment period. You can cancel at any time after that with 30 days notice. Annual subscriptions are non-refundable but auto-renew can be cancelled at any time.
Data ownership
Your data is yours. This includes: call recordings, transcripts, lead information, customer interactions, CRM contents, and any other data flowing through SAVIENA. If you cancel, we provide a full export within 30 days and delete our copies within 90 days (except where required by law).
Phone number ownership
Phone numbers we provision for you are owned by you. On cancellation, we port them back to a carrier of your choice at no charge.
Acceptable use
Do not use SAVIENA to:
- Send spam, unsolicited marketing, or harassment
- Violate any laws, including telecom regulations like TCPA
- Misrepresent your business or impersonate others
- Process payments for illegal goods or services
- Attempt to reverse-engineer or copy our systems
Violations result in service termination without refund.
Service availability
We target 99.9% uptime. Outages affecting calls or critical workflows are credited prorated against your next invoice. We do not guarantee specific business outcomes; we guarantee the system works as described.
Liability limit
SAVIENA's total liability to you in any 12-month period is capped at the amount you paid us in that period. We are not liable for indirect damages such as lost profits or reputation harm. This is standard SaaS liability language.
Disputes
These terms are governed by Florida law. Disputes are resolved in Florida state or federal courts. Before filing suit, we agree to attempt good-faith resolution by email within 30 days.
Changes to these terms
If we materially change these terms, we notify current clients by email 30 days before the change takes effect. Continued use after the effective date constitutes acceptance.
